1. Who you are contracting with

These Terms form an agreement between you and Collosal Trader Development ("Collosal", "we", "us"), the provider of the Collosal platform and related services (the "Service").

2. Acceptance

By creating an account or continuing to use the Service you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation. If you are an individual you confirm you are of legal age in your jurisdiction.

3. The Service

Collosal provides a behavioural intelligence and trade-planning platform with simulated trading environments. The Service is provided as software-as-a-service. Features available to you depend on your subscription plan.

4. Your account

You must provide accurate registration information and keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account.

5. Acceptable use

You must not misuse the Service. In particular, you must not: (a) use the Service for any unlawful purpose; (b) commit fraud, send spam, or impersonate another person; (c) infringe any intellectual-property or other rights; (d) attempt to probe, scan, scrape, reverse-engineer or otherwise interfere with the Service or its security; or (e) introduce malware or any other harmful code.

6. Intellectual property

Collosal and its licensors retain all right, title and interest in the Service, including all software, models, documentation and branding. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose within your chosen plan. You may not resell, sublicense or redistribute the Service.

7. Your content

You retain ownership of the content you submit to the Service (trade plans, journal entries, notes, etc.). You grant us a limited licence to host, store and process that content solely to provide and improve the Service.

8. Payments, subscriptions and taxes

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellation and refund mechanics are governed by Paddle's Buyer Terms, available at paddle.com/legal/checkout-buyer-terms.

Subscriptions renew automatically for the period selected at checkout until cancelled. You may cancel at any time through your account or via Paddle; cancellation takes effect at the end of the current billing period.

9. Refunds

Refunds are handled in accordance with our Refund Policy and Paddle's refund handling.

10. Service availability

We work hard to keep the Service available, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. We may modify, suspend or discontinue features from time to time.

11. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms, fail to pay, present a security or fraud risk, or repeatedly violate our policies. You may close your account at any time from your settings.

12. Disclaimers and trading risk

The Service is a simulated training environment. Nothing in the Service constitutes financial, investment, legal or tax advice, and it is not a recommendation to buy or sell any instrument. Trading involves substantial risk and you are solely responsible for your decisions. To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.

13. Limitation of liability

To the fullest extent permitted by law, our aggregate liability under these Terms shall not exceed the fees you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages, including loss of profits, data or goodwill. Nothing in these Terms limits liability that cannot be limited by law (such as for fraud or personal injury).

14. Indemnity

You agree to indemnify Collosal against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

15. Changes

We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after changes take effect constitutes acceptance.

16. Governing law

These Terms are governed by the laws of the jurisdiction in which Collosal Trader Development is established, and the courts of that jurisdiction have exclusive jurisdiction over any disputes, subject to mandatory local consumer-protection laws.
